This case happens to concern itself with an important point. It is the objective of the tribunal to figure out if the employer has a legitimate aim. If he is successful in establishing one, like in this case, then he should consider if the differentiation in pay happens to be a proportionate mean to be able to achieve the employer’s aim. To be able to come to the conclusion, the courts took reference of the decision made in a similar case of Kutz-Bauer v Hamburg  IRLR 368
(Hrcompanion.co.uk, 2011). In this case the court referred to the statement that needed to be considered and it stated that “the possibility of achieving by other means the aims pursued by the provisions in question.”
In this case the tribunal had rightly determined the fact that the Chief Constable had been pursuing a very legitimate aim and that was the wish to be able to reward those police officers who worked during the night. It is true that this pattern seemed to have a disparate effect on the women who had extra childcare responsibilities; however, there was no other ways in which this pattern of work and reward system could be carried out without having a considerable lesser impact on the women. It was irrelevant at this point that there were other forces who had come up and adopted such schemes that were devoid of similar impacts on the women. This was because these schemes did not seem to be pursuing the aim of working 24/7 (Casecheck.co.uk, 2011). If looked into the issue of justification of the case, it can be said that the outcome of the case was not surprising at all as it was a logical conclusion.
